Agreement to Terms

Welcome to InkFiction. By downloading, installing, or using our app, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

1. Description of Service

InkFiction is a personal journaling application that combines written reflection with AI-generated visual art. The service includes:

• Digital journaling with text, moods, and tags
• AI-powered visual generation from your journal entries
• iCloud storage and synchronization via CloudKit
• Single persona with 5 avatar style variations
• AI writing assistance to enhance your entries
• 9 customizable themes (5 light + 4 dark)
• Data export functionality (CSV format with high-resolution images)

2. User Accounts

2.1 Account Creation

• You must be at least 13 years old to use InkFiction
• You authenticate using your Apple ID via iCloud - no separate account creation required
• You are responsible for maintaining the security of your Apple ID and device
• You are responsible for all activities that occur using your Apple ID

2.2 Account Security

• InkFiction requires biometric authentication (Face ID/Touch ID) to access the app
• Your journal data is stored in your personal iCloud account
• We are not liable for losses resulting from unauthorized access to your Apple ID
• Report any security concerns to Apple for Apple ID issues

2.3 Account Termination

• You may delete your journal data through Settings or by managing your iCloud storage
• Uninstalling the app does not automatically delete your iCloud data
• We may suspend access for accounts that violate these terms
• Your iCloud data is managed by Apple according to their data retention policies

3. Acceptable Use

3.1 You Agree To:

• Use the app for personal, non-commercial purposes only
• Comply with all applicable laws and regulations
• Respect the privacy and rights of others
• Keep your account information accurate and up-to-date

3.2 You Agree NOT To:

• Use the app for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Reverse engineer, decompile, or disassemble any part of the app
• Upload malicious code, viruses, or any harmful content
• Scrape, crawl, or automatically collect data from the app
• Share or resell the app or any of its features
• Use the app to create competing products or services
• Impersonate others or provide false information

4. Data Storage and Cloud Services

4.1 iCloud Storage

By using InkFiction, you acknowledge and agree that:

• Your journal entries and data are stored in your personal iCloud account via CloudKit
• InkFiction does not operate servers that store your journal content
• Data synchronization occurs through Apple's iCloud infrastructure
• Your data is subject to Apple's iCloud Terms of Service and privacy practices
• You are responsible for managing your iCloud storage and maintaining backups

4.2 Third-Party Services

InkFiction uses third-party services to provide features, and you agree that:

• When using AI features, your content may be sent to third-party AI services
• Apple iCloud/CloudKit stores your journal data according to Apple's policies
• Third-party services have their own terms of service and privacy policies
• We are not responsible for the practices or policies of third-party services
• You should review the privacy policies of our service providers

5. Intellectual Property

5.1 Your Content

• You Own Your Journal Entries: All text, moods, tags, and personal content you create remains your intellectual property
• AI-Generated Visuals: You retain rights to AI-generated images created from your journal entries
• License to Us: By using the service, you grant us a limited license to store and process your content solely to provide the service
• Your Responsibility: You are responsible for ensuring your content does not infringe others' intellectual property rights

5.2 Our Content

• InkFiction, the app logo, design, and interface are our intellectual property
• Our technology, code, and features are protected by copyright and trade secret laws
• You may not copy, modify, distribute, or create derivative works without permission

6. AI-Generated Content

6.1 Visual Generation

• AI-generated visuals are created based on your journal text using AI models
• Results may vary and are not guaranteed to match your exact expectations
• Generated images are provided as-is for personal use
• We do not guarantee the quality, accuracy, or appropriateness of AI-generated content

6.2 AI Writing Assistance

• AI writing suggestions are provided through third-party AI services
• AI suggestions are provided as-is and may contain errors or inaccuracies
• You are responsible for reviewing and editing AI suggestions before accepting them
• By using AI features, you acknowledge that your text will be sent to third-party AI services

6.3 No Professional Advice

InkFiction is a creative tool for personal reflection. AI-generated content is NOT:

• Medical, mental health, or therapeutic advice
• Legal, financial, or professional counseling
• A substitute for professional services of any kind

If you need professional help, please consult a qualified professional in the relevant field.

7. Subscriptions and Payments

7.1 Free Version

InkFiction currently offers features at no cost. We may introduce premium features or subscriptions in the future.

7.2 Future Pricing

• If we introduce paid features, pricing will be clearly disclosed before purchase
• Subscriptions will be managed through the Apple App Store
• Refund policies will follow Apple's App Store guidelines
• We reserve the right to change pricing with advance notice to users

8. Privacy and Data Protection

Your use of InkFiction is also governed by our Privacy Policy. Please review the Privacy Policy to understand how we collect, use, and protect your information. By using InkFiction, you agree to both these Terms of Service and our Privacy Policy.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

• The app is provided "as is" and "as available" without warranties of any kind
• We do not guarantee uninterrupted, error-free, or secure service
• We may modify, suspend, or discontinue features at any time
• Third-party services (AI providers, cloud storage) may experience outages

9.2 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for data loss (you should maintain your own backups)
• We are not liable for third-party services, AI results, or content

9.3 Data Backups

Your journal data is stored in your iCloud account. You are responsible for:

• Managing your iCloud storage and backup settings
• Regularly exporting your journal entries using the data export feature
• Maintaining your own backups of important content
• Understanding that iCloud availability is subject to Apple's service terms

10. Indemnification

You agree to indemnify and hold harmless InkFiction, its developers, and affiliates from any claims, damages, or expenses arising from:

• Your use of the app
• Your violation of these terms
• Your violation of any third-party rights
• Content you submit or generate through the app

11. Changes to Terms

We may update these Terms of Service from time to time. Changes will be effective:

• Immediately upon posting for non-material changes
• 30 days after notification for material changes (via email or in-app notification)

Continued use of the app after changes constitutes acceptance of the updated terms.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

12.2 Dispute Resolution

• Informal Resolution: Contact us first at support@inkfiction.app to resolve disputes informally
• Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
• Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

13. Severability

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and InkFiction regarding the use of the app.
